Tale of a Perfidy
India’s actions in Occupied Kashmir have attracted universal negative attention. In over seven decades, successive Indian governments have undermined terms of the Instrument of Accession until all that was left of it was a skeletal structure. Now even that has been shot to hell.
India by virtue of its large area and a population exceeding one billion is regarded as one of the largest democracies in the world. But unfortunately it is beset with multiple cultural, religious, racial, ethnic and linguistic problems which have made it a country difficult to govern. The fathers of India made it a secular state because of its peculiar complexion and it was declared that all minorities in India shall have the same rights as its citizens. Before the coming into power of the Bhartia Janata Party (BJP), all Congress leaders had tried hard to project India’s image as a secular state. But the present leadership of BJP under Narendra Modi has taken a somersault and has openly declared India to be meant only for Hindus; all other nationalities and religions on its soil are declared as interlopers. India’s new citizenship law, the CAA, is also exclusionist as it provides a path to citizenship for every religion except Islam, which is practiced by roughly 16 percent of the country’s population, or nearly 200 million people. Besides making life difficult for the Muslims, Indian democracy is also faced with scores of other separatist movements. Is this leading to an implosion situation for India?
On October 27, 1947, Mountbatten declared, “the question of the State’s accession should be settled by a reference to the people. ”Similarly, the first prime minister of India, Jawaharlal Nehru, vowed at the UN General Assembly that there was no other way of resolving the Kashmir dispute but through a plebiscite where the Kashmiris should decide which side they wanted to join.
Narindera Modi has reversed all the policies of India’s former leaders and has adopted a policy of hostility and confrontation towards Pakistan. He has vowed to isolate Pakistan internationally and cripple its economy. His foreign policy is based on deepening India’s strategic collaboration with Afghanistan and other regional countries to isolate Pakistan. The world knows that the present insurrection in Kashmir is local and indigenous, while Pakistan has scrupulously kept itself away from the internal disturbances in the Valley. With such a hostile neighbour, Pakistan would rather focus its energies on internal security and economic stability because without economic stability, even the Kashmiris may not be too eager to join Pakistan.
Narendera Modi is a life member of the Rashtriya Swayamsevak Sangh (RSS), a paramilitary Hindu nationalist organization founded in 1927, inspired by the fascist movements of Europe. Adolf Hitler was their greatest hero. Just as the fascists of Germany took great pride in their racial superiority and purged their country of the Jewish minority, in the same way , the RSS takes pride in Hindu superiority which it terms as ‘Hindutva’ and firmly believes that all entities other than Hindus are intruders, who should be gradually eliminated from Indian soil. In 1948, a former member of the RSS murdered Gandhi for being too soft on the Muslims. The followers of the RSS are mostly dominated by upper-caste Hindus, and have since led many vicious assaults on minorities.
In 2002, as Chief Minister of Gujarat, Modi supervised the massacre of 2000 Muslims in Gujarat and displacement of a hundred thousand Muslim families from their homes. This was the darkest side of Modi until then. He could not be expected to be fair to Muslims in his latter career against this grim background.
The RSS considers Muslims as usurpers of their land and believes that India should be purged of Muslims, who should not have any civil rights at par with Hindus. The militancy of the RSS grew with time and by 2000, the movement had more than 60,000 branches and an army of 4 million volunteers. The BJP government undermines and insults the Dalit population. In a country ruled by Hindu nationalists, says author Arundhati Roy, “it’s safer to be a cow than a woman or Muslim”. Another Indian politician and writer, Shashi Tharoor, bitterly criticizes Modi for his policies to curb minorities, and likens him to a scorpion sitting on a statue of deity Shiva so that you can't remove him with your hand neither can you hit it with a 'chappal.’
The latest Indian perfidy over the Kashmir issue came to light when the Home Minister of India told parliament on August 3, 2019 that the President had signed a decree abolishing Article 370 of the Constitution, stripping the significant autonomy Kashmir had enjoyed for seven decades.
Through Article 370 of the Indian Constitution the State of Jammu & Kashmir was given an autonomous status as against other provinces. The residents of the Sate lived under different laws from the rest of the country in matters such as property ownership and citizenship. It was also stipulated that the status of Article 370 was provisional and the Article could only be revoked on the recommendation of the Constituent Assembly of the State. But that Assembly, after framing its Constitution in 1957, was dissolved without making any recommendation for revoking Art. 370, perhaps because it knew fully well that such a recommendation would deprive the state of its autonomous status, beside affecting the safeguards provided to the Kashmiries under Article 35-A.
Article 35-A, inserted in the Constitution by a Presidential decree in 1954, permits the local legislature in Indian-administered Kashmir to define permanent residents of the region. It forbids outsiders from permanently settling, buying land, holding local government jobs or winning education scholarships in the region. Thus by revoking this provision, India deprived the Kashmiris the rights and special status they had enjoyed for several decades.
The present status is that the Indian government does not have the power to unilaterally revoke Article 370, which was given to the State Assembly and which was dissolved in 1957. However, 35-A was inserted by a Presidential decree. The Kashmiris revolted against these steps but Modi clamped a curfew in the State, arrested Kashmiri leaders and atrociously killed the protesters. Through Article 35-A, any Indian citizen from any part of the country can now buy property in Jammu and Kashmir, take a state government job and enjoy scholarships and other government benefits. Thus the special status of Kashmir being a land for the Kashmiris has now been taken away. It is a sinister design to colonize Kashmir and t make it another Palestine as has been done by Israel.
"Muslims are not equal citizens."
“Muslims are not equal citizens since they pose a threat to the world. The country is with us on this issue and most people like our hard-line approach to solving pending problems. We know that the Muslim population is large, there is always trouble, because the Islamic ideology says so. If the Muslim population becomes more than 30 per cent, the country is in a danger. In fact, we are very kind to Muslims by now letting them come to India. The Article 14 of the Indian constitution has been widely misinterpreted. The Act cannot be faulted for that. This was the commitment we have made over several years, over several governments and we have completed the job. The Article 14 guarantees the ‘equality of equals,’ while all people are not equal. For Muslims, there are no such things existing as equal rights and they don’t even qualify for an equal category.
The Ayodhya verdict, which gave the land where the Babri Masjid once stood to the Hindus, meant that India has “regained its historical legacy.” However, the matter is not over, as dreams of Hindus will only be fulfilled when the temples in Mathura and Varanasi are also restored. Today, I perceive this country as one that has regained its historical legacy. If you have demolished a temple and then built a masjid on it, then I have every right to restore that temple. There are three temples that we want liberated for special reasons. Ram Temple where Ram was born, the Krishna mandir in Mathura where Krishna was born, and third is Kashi Vishwanath in Varanasi. When all three are restored, the matter is over.
Look at the Residential Welfare Association (RWA) Whatsapp groups where hateful messages against Muslims are posted openly. They have the guts to say it now. They did not have the guts to say it earlier. We would have never come to power if the sentiment is not there. Yes, it’s a toxic sentiment that can be cured by a mature presentation of what this nation is. Not by the hocus pocus that Jawaharlal Nehru dished out to us. You see that is where people felt that after all this history, we are still second class citizens. Whether they were or not is another matter. But they saw that whatever we were doing to accommodate Muslims as appeasement. When such things takes root, there is no use in using logic. You cannot block it unless you address the core grievance. The core grievance is that after all this effort to liberate our country back, and partitioning our country, we are still appeasing the Muslim population.”
